If either applicant is a resident of the State of Georgia, the marriage license may be obtained from the Probate Court in any county in the State.  If neither applicant is a resident of Georgia, the license must be obtained from the Probate Court in the county in which the ceremony is to be performed.  If the marriage will take place in another state, you must contact that state for the licensing information.  The following is a list of the requirements for obtaining a marriage license in Newton County.

The following is required for the issuance of a marriage license in Newton County: 

  1. Bride and Groom must appear in our office together to apply.
  2. Each will need at least one (1) of the following forms of identification:
    • State issued ID (Georgia Driver’s License or Georgia Identification Card)
    • Certified copy of birth certificate
    • Passport
  1. If you were previously married, you must have a copy of your most recent final Divorce Decree signed by the Judge or a copy of the Death Certificate, whichever applies.
  2. There is a fee for the marriage license in the amount of $56.00 payable in cash or credit/debit card only (7% fee is added with card pymts).  If you have had six hours of premarital counseling with a Minister, Professional Counselor, Social Worker or Marriage and Family Therapist you will receive a discount only if you provide a signed document stating you have completed six hours of pre-marital counseling.  The fee will be $16.00 and is payable in cash or credit/debit card only (7% fee is added with card pymts).   3. Office hours for applying for marriage license are 8:00 am to 4:00 pm.
  4. Georgia no longer requires blood tests for marriage license.

           As of July 1, 2006, the pregnancy of a female applicant no longer authorizes the issuance of a license to a 16 or 17 year old without consent.  If an applicant for marriage is 16 or 17 the following is required:

            Parental consent is required unless a parent’s rights have been terminated by a Court Order. The Court Order must be presented to court.  A certified copy of the applicant’s Birth Certificate, which has been issued within the past 45 days, must be presented.  Parents listed on the Birth certificate must show identification.  If the parents are no longer married, both parents will have to sign, regardless of who the custodial parent is.  If the parents were not married at the time of birth but the father legitimated the child, he is required to give consent.  If one of the parents is deceased, a death certificate must be presented.  If a legal guardian wishes to give consent, a certified copy of the Court Order of Letters of Guardianship, which has been certified within the last 60 days, must be presented.  No license may be issued if either applicant is under the age of 16.

 Obtaining Certified Copies of Marriage Licenses:

Once a marriage license has been issued and the ceremony is performed, the original (white) copy of the marriage license needs to be returned to our office in the self-addressed-stamped-envelope provided.  The court will then record the marriage record and it becomes a permanent record of that Court.  The court where the license was issued is the only court that can certify your marriage.

 To effect a name change or verify marriage by certification, the couple must obtain a certified copy of the marriage license.  Wait seven days after returning the original (white) copy to the court, then come into the office and request a certified copy of the marriage record.  You may request your certified copies via mail by sending a request with the following information: 

  • The groom’s name;
  • The bride’s name at the time of the application;
  • The date of marriage;
  • A photocopy of your identification;
  • and a money order (NO PERSONAL CHECKS) for $10.00 for the first copy and $1.00 for each additional copy requested at the same time.  (Example:  If you need three copies the money order would be $12.00.)
